ASC's Free Speech Policy

Anchorage Shopping Center, LLC recognizes the right of individuals and/or groups to exercise free speech within the confines of the mall common area. “Speech” means the expression of ideas or opinions through speech, pictures, written words or symbols, displays, or other expressive conduct, and includes the passing out of brochures or leaflets and the collection of signatures in support of or in opposition to a cause. Within the mall common area, however, the right to free speech must be exercised in a manner which does not interfere with the operations of the mall or with individual businesses or mall patrons. Therefore, the exercise of free speech is subject to the following guidelines:

  1. All persons must at all times obey the mall’s free and public safety regulations;
  2. No individual or group may block mall traffic, the entrances or exits to the mall or to any shop, or any display window or case. Persons found blocking travel, through the mall or any entrance should be instructed to move to the nearest location out of the flow of traffic;
  3. Anchorage Shopping Center, LLC requires that individuals or groups wishing to engage or engaging in activities which are potentially disruptive to mall business must register with mall management. The following groups or individuals should be instructed to register:
    1. Groups of two or more people engaged in concerted, non-shopping activity. This might include parading, shouting, singing, or chanting;
    2. Anyone carrying a sign or placard which is not directly attached to their own clothing or which is larger than clothing to which it is attached;
    3. Anyone attempting to solicit money, other donations or signatures or attempting to pass out leaflets, brochures, pamphlets, or flyers;
    4. Anyone attempting to set-up a table or display for any purpose;

Anchorage Shopping Center, LLC will allow all individuals or groups wishing to engage in activity for which registration is required to register and engage in the activity so long as they agree to obey the following regulations:

  1. The Mall’s fire and public safety regulations must be obeyed at all times;
  2. As children frequent the mall during all hours, nudity, sexual explicit displays, and displays of graphic violence are strictly prohibited.
  3. Activity must be confined to the areas of the mall designated by mall management for these purposes;
  4. No person or group may engage in such activities for more than four hours per day or more than one day a week without reaching an agreement with the mall for the rental of space. The Management of the mall reserves the right, in its sole discretion, not to agree to rent space to any individual or group for any reason;
  5. In the event that any conflict arises over the use of mall space under these rules, permission will be granted on a first come, first serve basis;
  6. No more than ten (10) individuals may participate in any registered activity at one time in one place and no more than five (5) individuals throughout
    the mall may participate in any registered solicitation.
  7. Amplification devices are strictly prohibited in any registered activity.
  8. Any group or individual wishing to distribute leaflets, pamphlets, brochures, or other printed material must pay a small fee in order to compensate the mall for the increased clean-up costs associated with such activities.
  9. Commercial speech, such as advertisement, is strictly prohibited.
